Accident Waiver and Release of Liability

(Posted for your reference; this is a copy of the terms that govern our events. These terms are a copy of those you agreed to when signing up for club membership).

I, the undersigned participant, acknowledge that participation in RC car racing events organized by Melbourne Comp Crawlers Inc. involves inherent risks and dangers. These risks include, but are not limited to, the potential for serious bodily injury, death, and property loss. The risks specifically include, but are not limited to: actions of other participants; malfunction or failure of RC cars; terrain-specific hazards such as slippery, uneven, and rocky surfaces; sun exposure; adverse weather conditions; and other natural environmental risks.

My participation in RC car racing events organised by Melbourne Comp Crawlers Inc. is voluntary. I certify that I am physically fit, have sufficiently prepared or trained for participation in these events, and have not been advised against participation by a qualified medical professional. I confirm that I am aware of and will adhere to all club rules and safety guidelines provided by Melbourne Comp Crawlers Inc.

In the case of an emergency, I authorise Melbourne Comp Crawlers Inc. to provide or seek medical treatment deemed necessary. I agree to provide emergency contact information and disclose any relevant medical conditions.

I confirm that any RC car equipment used by me in these events is safe and in good working condition. I also understand that I am responsible for my own equipment’s safety and compliance.

I agree to be photographed or recorded during these events and grant Melbourne Comp Crawlers Inc. the right to use my image or likeness for legitimate purposes including but not limited to marketing and promotion.

I hereby release, waive, and discharge Melbourne Comp Crawlers Inc., its directors, officers, employees, volunteers, representatives, and agents from any liability for personal injury, death, or property damage/loss arising from my participation in these events. This waiver extends to all acts of negligence by the aforementioned parties.

I agree that any disputes arising from my participation in these events will be resolved in accordance with the laws of Victoria, Australia, and agree to arbitration as a first course of action in dispute resolution.

This document is governed by the laws of Victoria, Australia. If any portion of this waiver is held invalid, the remainder shall continue in full legal force and effect.

I certify that I am 18 years of age or older (or, if under 18, this form has been reviewed and signed by my parent/guardian). I have read this waiver and fully understand its terms, understanding that I am giving up substantial rights by signing it. Signing this waiver is a voluntary act.
